Welcome to Hubchart’s web and mobile experience. This Hubchart Web & Mobile Privacy Statement (the “Privacy Statement”) describes our practices in connection with information we collect and use with the Hubchart BB2 portal, Hubchart Patient Empowered App (the "Site"), the Hubchart™ mobile software application ("Hubchart™ App" or the "App"), and other products and services provided on the www.hubchart.io website (all of the foregoing, collectively, the "Service"). This Privacy Statement is designed to describe our privacy practices, in a format that is easy to navigate, read, and understand. We are committed to treating your information with care and respect and managing our Service in a manner that is compliant with all applicable laws.

 

As you navigate our Site and/or App and communicate with Synchrony Telemed LLC (sometimes referred to as “Hubchart” “we” “us” or “our”), via the Site and/or App, we may ask you to disclose certain information so that we can provide the Service. In order for you to make informed decisions about whether to disclose your information to us via the Site and/or App, we are providing you with the following information about how we collect and use your information:

What is the scope of this statement?

 

This Privacy Statement applies to those websites and software applications (including mobile applications) that we operate and that contain a link to this Privacy Statement.

 

We are not responsible for the privacy practices of any third party service providers (including without limitation Internet Service Providers or cloud service providers) or other third parties operating websites or applications to which the Site or App link. Hubchart in no way endorses, or monitors the privacy practices of such third parties.

 

What information does Hubchart collect?

 

When you use the Hubchart™ Blue Button portal or the Service, Hubchart may collect two types of information about you: Personally Identifiable Information and Non-Personally Identifiable Information.

 

Personally Identifiable Information is information that is unique to you, including your name, phone number, email address, physical address and other information about you.

 

Non-Personally Identifiable Information is information that does not identify you personally, rather provides us with usage data, either individually or in the aggregate. Non-Personally Identifiable Information may include the internet protocol (IP) address of your device, geographic location, your browser software and operating system, your web server, the date and time you access our Site or App (as applicable), session information (such as download errors and page response times), information about your viewing and search history, and information about the referring URL and the URL clickstream to, through and from our Site or App.

 

How does Hubchart gather and use the information?

 

We may gather Personally Identifiable Information in various ways, such as when you voluntarily register or create a personal profile with us, or request the Services, or information from us. We may also automatically gather personal device information, including your physical location, IP address, data usage, and as otherwise set in this Privacy Statement.

 

When you use the App or Site, we collect Non-Personally Identifiable Information including but not limited to aggregate information about you and your use, including through the use of your IP Address or “cookies”. A “cookie” is a piece of information that Hubchart sends to your browser, which then stores this information on the hard drive of your computer and when using the Hubchart™ Web App. This information helps us to improve our services, the Site and App. Because this information does not personally identify you, we may use and disclose such information for any purpose permitted by law.

 

What are Hubchart’s data retention practices?

 

When creating a patient access app, you are giving us permission to access your Medicare claim data using the Blue Button 2 API and allowing us to store your Medicare claim data on our server. Only the account holder can access their data by logging into the App using a unique username and password. It is your sole responsibility to keep your data secured on your device by using the app and the device security tools provided. It is also your sole responsibility when allowing another user to access and view such information. This information is transmitted only once and is stored by the other user on their data repository which resides on a secured Hubchart server. You acknowledge and agree that we are not responsible in any manner for the information you so choose to share with other individuals using the App or Site, or for the loss of any data.

 

How does Hubchart secure information?

 

We believe the security and confidentiality of your information are extremely important. As such, we use industry standard encryption for Personally Identifiable Information stored in your device, during transit and at its backend server. Our technology uses industry best practice and standard encryption to secure your messages and other Personally Identifiable Information. We also have physical, electronic, and procedural safeguards in place to protect Personally Identifiable Information. Personally Identifiable Information is stored on our servers and protected by secured networks to which access is limited to a few authorized employees and personnel. To the extent possible, we de‐personalize the information when stored such that any information is non‐identifiable to you. In addition, the Hubchart App provides you with security tools to lock your device via a 4-digit PIN or by touch ID (for touch ID enabled device) or face recognition (for face recognition enabled devices). It is your sole responsibility to keep the App secured in your device by using the app security tools provided. In the event of a phone theft or if the device falls in the hands of an unauthorized user, it is your responsibility to protect the data by enabling the app security tools provided. You have the option to inform our support team via support@synchronytelemed.com to temporarily lock the user account or change the user password should the device fall into the hands of an unauthorized user. It is your responsibility to inform us of such an event. Hubchart will lock out a device provided the user is able to answer the appropriate security questions. It is also the responsibility of the user to keep their email (registered in Hubchart) secured as password resets are sent via this email. Notwithstanding the various security measures we have in place, and despite our best efforts, no security measures are perfect or impenetrable. As such, Hubchart™ does not ensure such information may not be compromised.

 

How is new information updated on the App?

 

When you login to and access your Medicare claims data on the App, you allow us to automatically retrieve and update new Medicare claims information on the existing data stored on our servers.

 

How does data sharing work?

 

When you access your Medicare claims data on the App and click “Share”, you acknowledge that you are voluntarily sharing part of your Personally Identifiable Information to the Hubchart contact you choose. It is your sole responsibility to verify the identity of the Hubchart user for which your Personally Identifiable Information will be shared. Sharing such information to another Hubchart user means you are transmitting specific items on your Personally Identifiable Information.

 

How do I manage my information?

 

You may edit or delete your own information directly through the App. Please note however, some personal data may be required in order for the App to function properly.

 

Who can use the service?

 

Our websites and software clients are not intended for or designed to attract anyone under the age of 13 and we do not intentionally or knowingly collect Personally Identifiable Information on our sites from anyone under the age of 13 (or older in some jurisdictions). We encourage parents to be involved in the online activities of their children to ensure that no information is collected from a child without parental consent.

 

Changes to the Privacy Statement.

 

We may modify this Privacy Statement at any time by posting the revised statement on the Site and/or App (as applicable) and providing You with notice via electronic mail or other forms of electronic communication. You can determine when this Privacy Statement was last revised by referring to the “last updated” legend at the bottom. Any modifications will be effective immediately upon such posting. Your use of or access to the Site and/or App after such modifications are posted will signify your acceptance of the modifications and your agreement to be bound by them. Notwithstanding the foregoing, any modifications to this Privacy Statement shall not apply to any dispute between us arising prior to the date on which we post the revised Privacy Statement that contain such modifications.
